1. Acceptance of Terms

By downloading, installing, or using the Toonable application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you should not use the App.

These Terms constitute a legally binding agreement between you and Toonable ("we," "our," or "us"). We reserve the right to modify these Terms at any time, and such modifications shall be effective immediately upon posting. Your continued use of the App after any modifications indicates your acceptance of the modified Terms.

2. Description of Service

Toonable is a mobile application that transforms photos into cartoon-style images using artificial intelligence technology. The App allows users to apply various artistic filters and effects to their photos.

3. User Accounts

Some features of the App may require you to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to:

Provide accurate and complete information when creating your account
Update your information to keep it accurate and current
Immediately notify us of any unauthorized use of your account
Ensure that you log out of your account at the end of each session

4. User Content

4.1 Ownership

You retain all ownership rights to the photos and images you submit to the App for processing ("User Content"). By using the App, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of providing and improving the App's services.

4.2 Restrictions

You represent and warrant that:

You own or have the necessary rights to the User Content you submit
Your User Content does not violate the privacy rights, publicity rights, copyright, or other intellectual property rights of any person
Your User Content does not contain any material that is unlawful, obscene, defamatory, pornographic, harassing, threatening, or otherwise objectionable

5. Intellectual Property

The App, including its content, features, and functionality, is owned by us and our licensors and is protected by international copyright, trademark, patent, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, or transmit any of the material on the App without our prior written consent.

6. Subscription and Payment

The App may offer subscription-based services. By subscribing to our premium services, you agree to pay the fees indicated. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel your subscriptions through your app store account settings.

7. Limitation of Liability

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the App
Any conduct or content of any third party on the App
Any content obtained from the App
Unauthorized access, use, or alteration of your transmissions or content

8. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without any warranties of any kind. We disclaim all warranties, whether express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Termination

We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the App will immediately cease.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
